MEMBERSHIP AGREEMENT
This Membership Agreement is accepted between Babakamp Turizm Tarım ve Ticaret Limited Şirketi, with exclusive rights on the website www.babakamp.com ("Site"), located at Karaağaç Mahallesi, Karaağaç Sokak No:43 Fethiye, Muğla, with the registered Mersis ID 0128047537700001 (hereinafter referred to as the "Company"), and the real or legal person who connects to the Site, accesses and views any information, image, or publication on this address, shares personal data by becoming a member of the Site, and consents to it (hereinafter referred to as the "User" or "Users").
2. Subject of the Agreement:
This Membership Agreement regulates the general provisions regarding the use of the Site by the User and the obligations of the parties in this context. From the moment the User connects to the Site, they are considered to have accepted all the rights and obligations specified in this Agreement, and they cannot claim ignorance of the provisions regulated in this agreement.
The Company's Privacy and Personal Data Protection Policy is an integral and inseparable part of this Agreement. Therefore, when the User approves this Agreement, they are also considered to have accepted the Company's Privacy and Personal Data Protection Policy.
3. Terms of Use of the Site:
3.1. It is optional for the User to provide the requested information when using the Site, becoming a member, or making purchases through the Site. If the User deems it inappropriate, they may refrain from providing personal information.
3.2. During the membership process, Users are required to provide certain personal information such as name, address, email address, phone number, and if these details are not provided in full, the membership request may be rejected. The Company will use the personal information and data of Users in a manner consistent with the purpose and will not share it with third parties without the User's consent. In this context, the User declares that they accept receiving commercial electronic messages from the Company by allowing the use of the information provided during Site membership.
3.3. The User consents to the use of the information requested by the Company or provided by the User, and the relevant information disclosed in transactions on the Site, for purposes such as statistical evaluations, authorized communication and marketing via e-mail and/or SMS/MMS through mobile phones, efforts to create databases, and market research, without revealing their identity.
3.4. If the User wishes to stop receiving Newsletter communications as part of commercial electronic messages, they can easily unsubscribe by clicking the "Click here to unsubscribe from our Newsletter" link at the bottom of the Newsletter or by sending an SMS to the number provided in the message.
4. Nature and Use of Personal Information:
In addition to the situations and conditions specified in the Privacy and Personal Data Protection Policy, by approving this Agreement, the User consents to the use of their personal information and data in the following cases:
4.1. Site Membership and Contests: The personal information of Users who want to become Site members is collected during the membership process to provide better service and for other appropriate purposes. The information collected in this context may be used during contests or draws organized by the Company through the Site.
4.2. Shopping Through the Site and Related Payments: Users consent to the use and storage of their personal information for the purpose of making payments for purchases made through the Site and the payment processes carried out by companies providing payment infrastructure and virtual POS services (including server or data storage units abroad).
4.3. Shopping Through the Site and Related Deliveries: Personal information related to Users can be used in the delivery of products purchased after shopping.
4.4. Surveys: Information about Users can be used for the development of new products, production, distribution, marketing, and advertisements of products. Participation in surveys on the Site is at the discretion of the Users.
4.5. Information Services: Users agree that Company representatives may contact them using their personal information and data for requesting more information about the services and products offered by the Company, answering questions and requests, providing access to specific areas within the Site, and communicating about Site activities. Personal information may also be used to deliver up-to-date information about product details and promotions to Users.
4.6. Other Information: The Company may collect information used for technical requirements, as well as for purposes such as the design and sustainability of the Site, proper display of pages on the site.
Information such as the browser used, operating system, visited pages, visit date and time, and whether the Site has been visited by Users before are automatically collected.
5. Updating Personal Information:
Users can perform processes such as adding, correcting, or updating personal information using their User passwords. The Company will not be held responsible for delays and problems in the services provided through the Site due to the non-update of personal information.
6. User's Age:
This Site is managed in accordance with the regulations in Turkish legislation. If Users are children, their access to the Site and use of the Site must be supervised by their parents or an adult, and it must be carried out within the framework of their parents' or an adult's permission and approval. Individuals under the age of 18 cannot become members of the Site or make purchases through the Site. If it is determined that a Site member is under the age of 18, the Company will immediately cancel their membership.
7. Collection of Other Information:
In some cases when Users enter the Site, technical information such as non-personal IP addresses may be automatically recorded through "Cookie" technology. This information may include Users' internet browser types, the domain addresses of internet service providers, the number of visits, the duration of visits, and character preferences. The cumulative number of visitors to the Site is tracked through this process. Personal information of Users is not included in this process. This non-personal information may be shared with the Company's affiliated companies, subsidiaries, and business partners. 8. Security of Personal Information:
Documents related to the security of personal information can be accessed at www.babakamp.com/kvkk and are integral and inseparable parts of this Agreement. The Company takes the necessary care to ensure the security of Users' personal information and data, as detailed in the documents accessible at www.babakamp.com/kvkk.
9. Other Sites:
The Site may contain links to other sites not owned by the Company. Since these other sites are not controlled by the Company, no responsibility can be attributed to the Company regarding their contents, products, services, or privacy policies. Therefore, Users are deemed to have taken on all risks, such as potential infringement of their rights, introduction of viruses into their computers, when downloading information or materials from these sites. It is the responsibility of Users to carefully review and accept the terms and conditions of use and privacy policies of these other sites. Downloading information from these sites may result in the use of Users' personal information, infringement of intellectual property rights, or entry of viruses into their computers. Users acknowledge that the Company cannot be held responsible for these situations.
10. Resolution of Disputes:
All disputes arising directly and/or indirectly from this Agreement and the use and access to the Site are subject to the laws of the Republic of Turkey. Accordingly, in the resolution of disputes, including those related to the validity or existence of this Membership Agreement, Turkish laws will be applied, and Fethiye Courts and Enforcement Offices will have jurisdiction.
11. Assignment:
The Company has the right and authority to assign the rights and powers arising from this agreement to third parties.
12. Amendments:
The Company has the right to make changes to this Membership Agreement without prior notice. Therefore, Users must regularly read the terms and conditions of this Membership Agreement to be aware of any changes. All changes made are effective from the moment they are uploaded to the Site. By continuing to use the Site, Users continuing Site access accept that they are aware of these changes and approve the changed terms and conditions.
